Express Elite Site Application Policy

Upon submitting the Webmaster Application Form ("Application") you will be placed in a special priority sequence to be reviewed by Eliteweb Incorporated (“Eliteweb”). Eliteweb carefully and meticulously evaluates each site to preserve the integrity and prestige of the Eliteweb database. Payment for Express Submission does not guarantee inclusion in the directory. As with all applicants, your site must be thoroughly reviewed. Express Submission does ensure that your application becomes a top priority for the Eliteweb reviewing agents. The fee for the Express Submission is absolutely non-refundable regardless of the outcome of your application. If admitted into Eliteweb you will be treated as any other Elite site in the directory, and will receive no special consideration. You will receive electronic correspondence from Eliteweb, with information as to whether you have been accepted or not, as soon as that information becomes available.

You may not apply again until you have received a report as to the status of your initial application. Submitting more than one application interrupts the reviewing process and may result in complete termination of your application. If you have been accepted into the database you will receive an e-mail indicating such. You will gain access to the Eliteweb Elite Site ‘members area’, named Webmaster Central, and your site will immediately be listed in the directory. If you have not been accepted into the database you must wait a minimum of 30 days before re-applying. During that time Eliteweb recommends that you modify your site (information, products, layout, policies, etc.) so that you can become Elite. Applying again without making any adjustments will return the same results. Eliteweb does not divulge specific information regarding a site’s acceptance/non-acceptance to any third party.

Eliteweb does not accept sites that are unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable. Eliteweb does not accept any adult or pornographic sites. Sites that contain such items will not be considered for inclusion in the directory. Upon submitting your Application you are certifying that there is no content on your site that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

Upon submitting the Application you are granting Eliteweb full use of your website information, without any need for notification. You understand that certain information will be made publicly accessible and are granting Eliteweb world-wide, royalty-free, exclusive rights to use said forth information. You are granting Eliteweb the perpetual, irrevocable and fully sub-licensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such content (in whole or in part) and to incorporate such content into other works in any format or medium now known or later developed. You also grant Eliteweb the right to contact you through the e-mail address you provide. As is congruent with the Eliteweb Privacy Policy, your contact information will not be sold to any third party. Any communication you receive will originate from Eliteweb.

Eliteweb reserves the right to cancel your application and acceptance (and forfeit all points), without reason or notice. Inclusion in the directory is a privilege, not a right. Eliteweb is constantly re-evaluating sites already admitted into the database, and should a site no longer qualify as “Elite” it will be removed. Upon submitting the Application you are agreeing to use the service in the manner in which it was designed. Any attempt to defraud or disrupt the normal flow of operations will result in immediate removal from the directory and possible punitive damages.

Eliteweb reserves the right to alter any and all information regarding your website. All changes and activities by our members are recorded. Those found abusing the system or acting in a manner determined to be unbecoming of an Elite site will be expunged from the database.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, any portion of the service, use of the service, or access to the service.

Eliteweb reserves the right at any time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that Eliteweb shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.

As a member of Eliteweb you may be exposed to special advertisers’ messages. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through Eliteweb, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Eliteweb shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the service.

You agree to indemnify and hold Eliteweb, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the service, your use of the service, your connection to the service, or your violation of any rights of another. You expressly understand and agree that Eliteweb shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if it has been brought to the attention of Eliteweb that there is a possibility of such damages), resulting from: (i) The use or the inability to use the service; (ii) The cost of procurement of substitute goods and services resulting from any goods, data, information or service purchased or obtained or messages received or transactions entered into through or from Eliteweb; (iii) Statements or conduct of any third party on the service; (iv) Unauthorized access to or alteration of your transmission or data; or (v) Any other matter related to Eliteweb.

Your use of Eliteweb is at your sole risk. The service is provided on an "as is" and "as available" basis. Eliteweb expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Eliteweb, and all matters concerning Eliteweb, shall be governed by the laws and rules of the province of Ontario in the Dominion of Canada.

Eliteweb holds high standards for itself and for its members. In applying and possibly becoming Elite, you are agreeing to these standards.
